Over the past few years, New York City has made several important updates to the NYC Childhood Lead Poisoning Prevention Act (Local Law 1 of 2004), strengthening existing lead laws and expanding inspection requirements for landlords and building owners.
In recent years, New York City has taken significant steps to improve the NYC Childhood Lead Poisoning Prevention Act (Local Law 1 of 2004), which includes measures to strengthen lead laws and expand inspection requirements for landlords and building owners. One of the most recent changes, Local Law 31 of 2020, took effect on August 9, 2020, requiring landlords of old residential "multiple dwelling" buildings to hire EPA-certified inspectors to conduct X-Ray Fluorescence (XRF) lead inspections.
This law also includes a 5-year testing requirement that mandates all residential building owners in New York City to have all dwelling units inspected for lead paint by August 9, 2025.
For apartments with children under the age of 6 residing there, the law requires much earlier inspections, with a deadline of August 9, 2021, just one year after the law went into effect. Additionally, if a family with a child under the age of 6 has recently moved into an apartment, the landlord must conduct lead testing within 1 year of their move-in date.
It is important to note that recent changes in the law now require smaller landlords and vacation rental owners to follow the same lead paint rules as larger building owners, unlike previous years. As per Local Law 29 of 2020, the definition of buildings with “multiple dwellings” now includes one and two-family house rentals, with the exception of units occupied by the owner's family. These updates reflect the city's ongoing commitment to reducing the risk of childhood lead poisoning and ensuring safer housing conditions for all New Yorkers.
Childhood lead poisoning is a significant public health concern, as lead exposure can cause a range of health problems, including developmental delays, learning difficulties, and behavioral issues. New York City has recognized the severity of this issue and has taken several steps to address it over the years.
